Texas AG Announces Probe of Power Crisis

February 19, 2021 — Attorney General Ken Paxton announced Friday evening that his office is filing Civil Investigative Demands (CIDs) for ERCOT and power providers over “power outages, emergency plans, energy pricing, and more related to this week’s winter weather disaster.”

CIDs were issue to AEP, Calpine, CenterPoint, ERCOT, Griddy, La Fontera, Luminant Generation, NRG, Oncor, Panda Sherman Power, Temple Generation and Texas-New Mexico Power Company.

In a statement, the AG’s office said, “The large-scale failure of Texas power companies to withstand the winter storm left multiple millions of Texans without power and heat during lethal, record-low temperatures across the state.

“I’m using the full scope of my Constitutional powers to launch an investigation into ERCOT and other entities that grossly mishandled this week’s extreme winter weather. While Texans pulled together to get their communities through this disaster, they were largely left in the dark.”

“We will get to the bottom of this power failure and I will tirelessly pursue justice for Texans.”

A CID is used as an investigative subpoena by administrative offices and executive agencies as part of facts discovery in acquiring information important to an investigation.

Discovery usually happens as part of the legal process after charges or lawsuits are filed, but CIDs are often used before any complaint is filed by government offices and CIDs are often used at or before the beginning of lawsuit against those who received them.
